If any provision of these Terms is found to be invalid under any applicable law, such provision shall not affect the validity or enforceability of the remaining provisions herein.

He served as President and Chief Commercial Officer of Peabody Energy Corporation from 2008 until 2012 and as Peabody’s Chief Financial Officer and Executive Vice President of Corporate Development from 1999 to 2008. Prior to joining Peabody in 1993, Mr. Navarre was a senior manager with KPMG, LLP. Paul A. Lang has served as our Chief Executive Officer since April 2020 and also served as our President from April 2015 to February 2024. Prior to that, he served as our Executive Vice President and Chief Operating Officer from April 2012 to April 2015 and as our Executive Vice President-Operations from August 2011 to April 2012. Since joining the Company in 1984, he has also held a variety of engineering and operating positions at both the Company’s eastern and western operations, and served on the Company’s Board from 2014 through 2016.
